Legal Question in Criminal Law in Missouri

My husbands probation was revoked because the police were called to our home for a domestic dispute between myself and my sister in law, neither one of us pressed charges and the police then left. one month later my husband my husband got paperwork in the mail stating that the prosecuting attorney had filed a motion to revoke his probation because of this incident between me and my sister in law.the police report stated that he " appeared" intoxicated, but never once did a breathalyzer, blood, or a urine test. he had no prior violations through his state probation officer, and at that time had just started new psych meds that caused side effects including drowsiness, dizziness, and so on. so they assumed he was drinking which would be a violation of his probation.

So what is your question? If his probation has already been revoked as you say it is unlikely that the Judge will "unrevoke" it. If, on the other hand, your husband is facing a Motion to Revoke, he should hire an attorney right away to present his side of the story and hopefully avoid the revocation.
