Legal Question in Criminal Law in Missouri

I was talking to a friend of mine in a gas station parking lot. She was sitting in the van, while I was standing outside of her car. A police officer arrived and asked what we were doing. When we replied back that we were socializing, he asked my friend what was in her pockets. The contents were a cell phone, bills, money and a bottle of prescription medication. The officer assumed that I had the intent to buy them from her. He searched both of us with a kanine and found nothing but confenscated the prescription bottle and the pills. I now have a warrent for my arrest for intent to buy drugs. Can they really do this? The pills in her pocket were hers, and we honestly didn't break or have the intent to break the law..

In Missouri, one can be charged with 'constructive possession' if he has access to contraband. Did you or your friend make any statements to police about the pills? Did your friend have a prescription for the pills? Feel free to email me at [email protected] or call 913 441 5025 if you want to discuss this further.
