Legal Question in DUI Law in Missouri

My son was recently struck by a drunk driver, he the driver was arrested I have on film the process of being arrested, my son was not hurt thank goodness but his vehicle a 1992 RS Camero with a new motor, exhaust, wheels and tires etc., is wrecked, his insurance company only wants to settle to $2300.00 I cannot fix the car or buy a compatable one for that amount. Is my next action to contact an attorney? Should I argue with the Insurance Company? Need assistance they are giving us the run around and it wasn't our fault. Please advise.

You need to find comps. That is comparable vbehicles selling in yrou area. If you have repalcement value insuarnce, your insurer would nee dto heed yoru copmps in setting a pay out amopunt. If you do nto have rider on yoru poliocy for replacement value, you will only get fair market value. That is the value of a similar or exact year car with similar miles, etc. This is usualy close to teh NADA or Kelly Blue book vlaues. If you do not thin kyou can address these questiosn yourself, then you shoudl meet direclty with an attorn in your area. They can look at the specifics of your policy and hte damges to the vehicle and advise you as to yrou options. Many attorneys offer a free or low cost initial consultation.
