Legal Question in Family Law in Missouri

I got custdoty of my son and my ex was ordered to pay child support. She is now 1 1/2 months behind and is trying to appeal the judges ruling. Is there anything I can do. she is very rude and talks about me to my son. Plus she doesn't want to pay her share of travel etc.

I am sorry to hear that you and your Son are going through this. Determining whether you can successfully defend or oppose your Ex's Plea to the judge, would require more facts than you have provided here.

If the payment of traveling expenses is not already addressed in the Visitation Order, you should try to get it in. If it is, you may need to enforce that and the delinquent support through the Court. You may need to Request that the Court address the bad mouthing issue. You did not say WHAT your Ex was saying about you to your Son. If it is is spurious or scandalous, (and false) the Judge may Enter an Order for her to refrain from making derogatory comments about you in the child''s presence. Words alone can seldom be the sole basis, but if it is serious enough, the Judge might require that her visits be supervised.

If she has filed an Appeal, and is not complying or paying what the present Order states, you need to consult directly with a family law practice attorney. Start with the one that last represented you in the Custody/Support case. If you choose not to go back to them, many other Family law attorneys offer a free or low cost initial consultation. Gather your documents and contact one in your area, or the state where the custody case sits.
