Legal Question in Family Law in Missouri

my sons father has not seen him since October 31st, 2012 my son will be 5 in august, I went to court for custody November 2nd, 2012 where he was granted visitation rights, but also was supposed to be paying child support (he didn't even show up to court). It has been 3 and a half years and he has not paid child support once, nor tried to contact me or our child. He has been to jail countless times for drug charges as well as theft and much more, and is now serving a 5 year sentence in prison.

I am wanting to have my sons last name changed as well as his parental rights removed.

Is there a way I can do that?

You can change the name by filing for it; you cannot terminate parental rights unless you have been married to someone else for 6 months and your new husband wants to adopt.
