Legal Question in Civil Litigation in Missouri

Check sent to wrong person?

Three years ago I had hired a property management company to take care of renting my condo. After five months the contract was cancelled because it was suspected they were renting the condo and not paying me. They tried suing me for breach of contract and I counter for loss of rental income. They agreed to drop the suit if I agreed mutually which I did. Last month I received a check from them in the amount of $722.50 which had my name and address on the check. Today they called me and said it was supposed to be mailed to another person with the same name as mine. They are threaten another suit for forgery if I do not send them the money back. What should I do?

Re: Check sent to wrong person?

The first question that comes to mind is why this check might actually be yours. Have you looked at the property to see if there is a tenant? Have you asked for an accounting of rents?
