Legal Question in Civil Litigation in Missouri

Vehicle ownership

I was given a motorcycle as a gift from my girlfriend. We are now broken up and she wants the bike back. Both our names are on the title and she is the only name on the note. I have possession of it now. I have a friend who she asked to ride the bike to the house to surprise me with it.

Re: Vehicle ownership

You own the bike jointly. However, if she intended it as a gift, it would be difficult for her to reocver the gift under Missouri law. However, I would think the honorable thing to do under the circumstance, to keep things from degenerating further between you, would be to offer to pay her something for the bike. But if you choose not to, then she could certainly sue you to recover or "replevin" the bike. Whether she would win is an open question, and one I cannot answer without more facts.

Good luck
