Auto accident nightmare

I was a passenger in a car that hit a deer going about 45mph, and did serious injury to my neck and lower back. (I did have on my seat belt)The persons insurance is not going to pay for my medical bills because they said she is not legal responsible for the accident and therfore they are decline my claim. The insurance claims rep. did not even ask me any questions nor did he tape the conversation. She has medical coverage on her insurance - can they do this! I do not live or work for her. I don't think that since I was in her car and she was driving that i should have to pay for my medical bills.

Help please

Generally speaking a person is not liable for another person's injuries unless that person has been negligent or otherwise acted to cause the injuries. However, most "medical payment" provisions in automobile insurance policies pay claims regardless of the driver's negligence. I would suggest that you hire an attorney to assist you by reviewing the insurance policy itself and perhaps contacting the insurance carrier on your behalf.
