Legal Question in Intellectual Property in Missouri

PGA Player Image Licensing

Is it possible for me to purchase product images of Tiger Woods from a company who has the licensing rights to his image, and then alter the product and resell it for a profit? Would I be affected by the original licensing in any way?

Generally when you license an image or a logo, you agree to use it in a particular format. Altering an image after agreeing to a licensing agreement that will most likely specify use of the image without alteration would be breach of contract and subject you to litigation. Feel free to contact me if you'd like to pursue this matter. Good luck.

The prior advice from Amy Gosh is incorrect. You are free to modify the item you bought in anyway you want (provided you do not do it in such a derogatory way as to be slanderous) and sell the modified item. You may not, however, reproduce the item in identical or modified form without risk of copyright and/or trademark infringement. I think you were asking about modifying and selling the individual item, which is okay, and Amy was replying about mass production of modified copies, which is not okay. If, however, you are talking about multiple copies in modified form, Amy is right on the money. Don't do it.

I am sure the licensing agreement explicitly says that they can not sublicense his image. Please refrain from doing such thing!!!
