Legal Question in Real Estate Law in Missouri

Left and am still being charged

Writing in for my brother. He left his wife 3 months ago and told the landlord that he was moving out. Wife did not pay rent after his vacating and they together are now being sued for the past rent and damages. Is he responsible since he told the landlord that he is out? And for how much of it?

Re: Left and am still being charged

Waht your brother's lease says about early termination and the other aspects of teh tenency will provide most of the information you need. If your brother told the landlord that he is surrendering the premises back to him, and he was the only one on the lease, than He may be able to minimize his damages. However, if both husband and wife were on teh leae, and they remain married, husband is just as liable for the rent as is his wife.

The relative devision of this debt would be assigned in divorce court, but that may not prevent landlord from coming after both or each of them.

Good Luck
