Legal Question in Real Estate Law in Missouri

I made an agreement with another party to purchase a motorcycle from me. I put all the details into a contract and we both signed it in front of a notary. I typed the agreement myself. In the past 2 1/2 years, the other party has made very few payments on the motorcycle and hasn't even paid those on time. The title, insurance, taxes, loan, etc are all in my name only. I have made all the payments to the bank, all the insurance payments, and paid all the taxes. I have proof of all of this. The other party has had sole possession of the motorcycle since April 2010. The other party has refused to tell me where the motorcycle is. Since the other party has not made the payments like we agreed upon, I have asked for my motorcycle to be returned to me. He has refused to do so. Do I have a legal right to reclaim my motorcycle? If so, do I have to return to him the money that he has paid on the motorcycle over the past 2 1/2 years? If I take this matter to court, will I need an attorney to represent me? Both the other party and I lived in Missouri when the agreement was signed and are currently living in Missouri. The other party and his mother have threatened me concerning this matter. I know this will be an ugly situation but I feel that the motorcycle belongs to me and should be returned since the other party has not kept his part of the deal we agreed upon. Any assistance you can provide in this' matter will be greatly appreciated. Sincerely, Connie Emerson ([email protected])

If the agreement was sifficiently drafted, you should be able to repossess the cycle, sue for the balance of the debtr, or acombination of a little of both. You need to consult direclty with a civil practice attorney in your area. Many offer a free or lopw cost initial consultation. Take you written agreement, and get advice specific to your situation.

Good luck
