Legal Question in Real Estate Law in Missouri

what do i do to get someone off my property deed?

my father and i bought property with a house one it about 11 yrs ago. wanting it to stay in the famiy, we also put my brothers name on the deed even tho he never paid a penny. father has died and there was a lot of tention between his three children about who it belongs to. brother thinks it's his because his name is on the deed, but has never done any work or paid any taxes on the place. sister thinks it's hers because an earlier will that parentshad made named her boss hog on different property; not this one. she also, has never worked on the place or paid taxes on it. my husband and i have done it all

i do have all the tax reciepts to show who has paid. can dig up the reciepts on all the repairs that my husband and i have made.

what can i do to get this in my name only?

If the transfer putting your brother's name on the property was a valid one, and if the ownership of the real estate was in joint tenancy then the real estate became the property of the surviving joint tenants at the time of your father's death. I can not determine all of these facts from the contents of your question. In order to provide competent legal advice it would be necessary to interview you (and perhaps your brother),review the deed and any other pertinent legal documents, and perhaps conduct a bit of legal research. If you are not already represented by legal counsel, you may call me at 314-727-2822 for a free telephone consultation. Thank you.
