Legal Question in Wills and Trusts in Missouri

I will inherit property from my aunt when she passes. she also has 3 additional proterties that she has not willed to anyone as she intends to sell the properties before she dies. If she does not get them sold before she dies who will inherit the properties? My father (who is her brother) and I are her only close relatives.

Based only upon the facts your provided, it sounds like your father wil inherit the remainder of your Aunt's estate. However, there are several things that can alter waht ends up in the remainder of a probate estate. You might suggest that she consult with a probate or estate planning attonrey in her area. Most people are unaware of the tax and benefit eligibility effects of how one bequeaths or transfers property. If she errs now, all the properties could be sold to pay for the costs of the illness/injury that takes her life, as well as reimbursemenbt of nursing home bills. If there are tax implications, you or your father might have to sell one or more properties to pay them. If these are not her intentions or wishes, she needs to get advice.

Many probate and estate planning attorneys offer a free or low cost initial consultation. If you can tell me, via email identifying this posting, I might be able to refer her to someone. If you, God forbid, think you might inherit from her in the next year or two, you should get some advice specific to these propert(ies) too.

You are smart to seek this informatio and guidance now. Too many people wait too long.

Good luck
