Legal Question in Appeals and Writs in Montana

College

My son is on a basketbal scholarship and is enrolled in the elementary education program. He is on going on his last semester and he has to attend a student-teacher internship for his last semester. He was denied by the teacher education committee of the school. Because he was going to miss to many days(8-10days). He is only allowed three days. A former basketball player attended the same program and was allowed to miss the same amount of days. This player was white and my son is african american. The educational program is the same and they both are or were playing the same sport. The only different between the two is race. I disagree with the committee decision and would like to receive some type of recommentdation towards some type of appeal process. The school hasn't or doesn't have any type of recourse as far as i know, for this matter. The name of the school is rocky mountain college in billings montana. A response in this matter would be greatly appreciated. Thank you vbery much, mr. Swan

Try writing the President, or other official a letter (not an email.) If you write one of the officials, send and show a copy to the President.

Also fax the letter. Go to the college's web site and you can get the details.

Tell him your concerns and ask for a copy of the bylaws/rules of the college for review/appeal of committee decisions.

You may not need a lawyer. But before you do this, and assert what you believe are racial circumstances, confirm the facts about the prior white student. The facts might not be as you were told them, or as you believe them to be.

If you cannot confirm these facts, then still write and just leave out the racial aspects and seek review/appeal. You can bring up this matter later if you need to.
