Legal Question in Business Law in Montana

Haunted House Entrance Fee

I was wondering if it is at all legal to charge an entrance fee for a haunted house that I will be setting up next year for Halloween? I will be donating 40% of the total profits to the UNICEF corporation, and the rest of the total profits will go to the following years bigger and better house. Is this possible, and if it is, do I have to do any paper work or get any permission of any kind before-hand? Thanks!

Re: Haunted House Entrance Fee

The best way to do this would be to incorporate as a non-profit corportation. First, you need to insulate yourself from personal liability in the event that someone were injured and decided to sue you individually. Second, you need to insulate yourself from tax liability should the intention for the funds for next year's haunted house be misinterpreted by someone. You may also be well served by a premises liability insurance policy covering the place where you have the haunted house. It may be that there is a policy in existence that would cover your event. You should also check local regulations in whichever town you live in as there may be requirements you need to meet to be in compliance with local ordinances. Good Luck.
