want access to mom's medical records after death

my boyfriends mother died in a rest home after a car accident in montana. her brother in law was made guardian after she was in a coma for a month and found not able to make decisions when she regained consciousness. the brother in law also had power of attorney. as her oldest son and closest blood relative, my boyfriend has never been given any satisfactory information regarding her death. the brother in law is not cooperating in giving any information, and my boyfriend would like to know what happened to his mother. does he have a right to get the medical records and if so, how would he go about doing that? my boyfriend was and is living in ny and is distraught as is his father over not having any information. also, is there any way to track what has happened to the driver of the vehicle? he never was charged, but there is some evidence he may have had his blood alcohol tested at the hospital the day of the accident. again we have no facts as no one is talking to us. can you help? thank you.

There are plenty of ways to find out what happened.

The question is Why the Secrecy?

Could there be a lawsuit that they expect to make big money? Or could they be involved in the accident somehow.
