Who can have the house?

My mom died and the house was still in her and my dad'd name. My ''old maid'' sister lived with my mom till she died and now says the house belongs to her. She kept all the memorial money for herself also and said she is entitled cuz she had the life insurance policy on mom that paid for her funeral. There are 6 kids and her and my brother have moved in together in the house and won't speak to the rest of us. What is our recourse?

It depends on how the house was titled at your mother's death. If your sister was addded to the title as a joint tenant to the house title, then she takes at date of death. If she was not added to title some type of probate proceedings will have to occur. It would be up to what your mother said in a will or, if no will, probably split equally among kids.
