Legal Question in Family Law in Nepal

Divorce

I married my wife in 2000 but after a year, we separated due to irreconciable differences. I asked her for a divorce but she refused. In mid 2001, I left Nepal and came to the USA. Since then, I have never been to Nepal and have been separated from her for almost six years now. I would be very grateful for any advice on how to get a divorce from her without leaving the US. Thank you very much.

You should start by hiring a divorce lawyer who is familiar with international divorces. He need not know anything about Nepal. He will need to contact the consulate in NY to find out the rules there. He will then hire a legal representitive there and the work will proceed. There maybe a way it can be done in US courts but I am not sure how the US court could gain jurisdiction if your ex-wife has never lived or visited here.

If you do not know of a good divorce lawyer who is familiar with foriegn divorce law, call the NYS Bar Association for the chair of their Matrimonial committee or the NY County Lawyers Association. Each Borough has a Bar Association and there is always the NY State Bar Association in Albany. You can also check to see if the Family law Professor in one of our local law schools knows of a former student or fellow attorney who would be able to help you.
