car payments

Hello, i want to claim bankruptcy, but i have a car , but the problem its that i'm 3 months behind in car payments. its there anyway i can keep the car ,because the car I have's a co-signer . Its that possible ?

If you are considering a regular Bankruptcy under Chapter 7, it will be up to the lender whether they will argee to give you time to catch up on the payments. It is possible, but there would be no guarantee. If you are considering a Chapter 13, you and your attorney can formulate a Plan by which you get caught up on your payments, and as long as you meet your obligation under the Plan, you will be able to keep your vehicle.

I agree with the other lawyer, but she did not tell you another thing. If your car gets repossessed and you file for bankruptcy within three weeks of them taking it, you will get your car back from the creditor just because you filed for bankruptcy.

You want to make sure that you have a copy of your insurance card, because they will require proof of insurance before giving you the car back but most people keep their proof of insurance with the car. So keep a copy at home to make your life easier.
