Legal Question in Bankruptcy in Nevada

I live with my mom and my brother ,and my mom getting SSI income $850 a month. and she has like 15K credit card debt . My brother file his taxes individually and I claim my mom as a dependent, and for last few years I was paying her bills but I can't do it any more . Me and my brother together make 100K a year which is more than median income for household size 3 . I want to know can she still file chapter 7 bankruptcy since she can't pass the means test ?

I am confused by your question - are these debts your Mom's? Or are they yours? If they are only Mom's, she might want to look at filing bankruptcy. But, on the other hand, if these debts are yours, why would you include your brother's income when filing for bankruptcy?

Yes, bankruptcy laws are complicated. However, I have spent 40+ years working in this field. So if you need to file for bankruptcy, please get in touch with me. If Mom wants to walk away from her debts, she may have several options to avoid paying these debts. But the devil, as they say, will be in the details. So I urge you to consult with a qualified bankruptcy attorney.
