Legal Question in Business Law in Nevada

Small Claims sue for damages

Tomorrow I have case in small claims court where i'm sueing the def for an unpaid invoice from Aug. His lawyer has contacted me 2x in the past week trying to get me to drop the case by claiming they will sue me for damages if i go ahead with the case. they tried to settle last night by returning the merchandise from the unpaid invoice, but only returned 1/2 of the equipment, so i refused.

Once i filed the case, i didn't contact the def in any way. - Do they have any grounds to sue for damages if i move ahead with my SCC case tomorrow? Thanks!!

Re: Small Claims sue for damages

From what you wrote "no" and I think that it is a scare tactic. However, there is a lawsuit called abuse of process and if you have improperly sued them, they will sue you later and get attorney's fees. If you win, obviously there is no abuse of process but if you lose, contact me and we can discuss what to do next.
