Legal Question in Consumer Law in Nevada

internet service contract cancellation

I signed up with clearwire less than 48hrs ago. I was told by the salesman at the store that it had a ''guaranteed'' connection speed of 1.5Mbps/256kbps, however for the 1.5 days I've had it, it has actually been 400kbps/35kbps. They also charged me $5 for a modem lease, but also charged me $100 to buy a modem so I don't know why I'd be leasing something I own. This isn't close to what I'm paying for. I asked to cancel the contract and was told it wasn't possible without me paying $220 as an early cancellation fee. Since then they have tried to charge my card (won't tell me why) so many times that the bank put a fraud hold on it because they realized something wasn't right. I contacted them again and told them to stop trying to charge my card since I was cancelling, but was told ''no''. I repeated I wanted to cancel and was told ''tough shit'' and was promptly hung up on. I'm in NV, but the contract has a stipulation of all complaints being held under Washington state law. What are my options for terminating this contract? Which state's laws do I have to look at?

P.S. their TOS is located at the bottom of their homepage if it helps at all

You would benefit from having a law firm dealing with them. My firm has attorneys in CA and WA.
