Legal Question in Criminal Law in Nevada

I recently got an MIPC fine while walking home from a party. I was with another person who was holding a beer when the police car pulled up. That should be an automatic MIPC (NRS 202.020) for possession. I was holding nothing, but we were both breathalyzed. I blew a .041 and was given a fine. I have no idea what my friend blew but he was not given a fine at all. Can I use this as a defense in court? Is the considered police negligence?

Negligence is not a defense in criminal cases.
