How old must a child be to decide what parent they want to live with?

There is no legal age for this although teenage discretion is given consideration to the minor once he or she reaches 14. Some children mature better or faster than others so a Judge will usually have a caseworker interview the child as to his or her parental preferences as to custody. Children are not to be brought to Family Court to testify or give Affidavits.
