Custody/Adoption

I currently have full physical and

joint legal custody with my ex-

husband. My son is 5. My ex has not

seen him since he was 9mos. old and

does not want anything to do with

us. He says he would like to give up

all rights so he doesn't have to pay

for him anymore (I garnished his

paycheck for support). I will be

remarried in summer '08 and my

new husband would like to adopt my

son. Since my ex is so easily

consenting can I do this on my own?

Where do I start?

You have to do two proceedings.

1. A Termination of Parental Rights by consent.

2. An Adoption

I would suggest getting a paralegal if you cannot afford an attorney.

Wait until after you get married and have the father sign a consent to a step-parent adoption. Then do the adoption. Termination of parental rights as suggested by Mr. Smith should only be done if the ex will not sign as it is expensive.

The lawyer doing the adoption with you should have the consent form.
