Grandmother has guardianship & won't give it up

My friends mother took guardianship of her son a couple of years ago. He was in need of surgury & grandmom had insurance. The deal was grandmom would give guardianship back to my friend when she obtained her own insurance from work, but now refuses. My friend has been forced to serve her mom for court. Grandmom has no reason for holding her grandson from his mom other than she 'wants' to! Does my friend have a good chance in Guardianship court? My friend is gainfully employed, no drugs, no alcohol, no mental problems and has always cared for her son & has custody. Grandmom has contributed financially and feels this entitles her to have her grandson as her own. She intentionally keeps him from his mother based on guardianship.

It appears that the grounds for the guardianship are no longer required and your friend should ask the court to terminate the guardianship.

You are asking attorneys questions about a Judge's opinion. It all depends on the Judge hearing the case. Everyone is different. The Court has to do what is in the child's best interest, not grandma's or your friend's.
