illegal marriage

My husband and I got married in Las Vegas Dec '05 wew have been seperated on and off for the last three yrs. He lied on our marriage license and stated he had never been married before when he had yrs ago but has been divorced for over 20 yrs. We have been seperated due to him taking drugs and fell off thedrinking wagon. Plus he has cheated on me and beat me up. Can I get my marriage ANULLED???

Based on what you have written, pusuant to section 6.109(b) of the Texas Family Code any suit for annulment would have had to be brought within one-year of the date of marriage. As such, it appears that you would not be eligible to file a petition for annulment. I would suggest that you consider filing a petition for divorce. Probably not. You would have to convince the judge that you would not have married him if you knew he was divorced 23 years ago.

I think you've waited too long. If he was divorced at the time he married you the lie is not material enough to get an annulment.
