Legal Question in Family Law in Nevada

moving out of state with my child

I am moving out of state because of a better job and I am taking my 10 yr old daughter. Her father and I have never been married and have not been together for 6 yrs. He has her 2 days a week and I have her 5. He says I cannot take her. We have no legal agreement and I have never received child support. Can I still take her out of state? What should I do?

Re: moving out of state with my child

Nevada treats married and unmarried fathers alike. You will need to Petition the court to move out of state with your child unless you can get her natural father's consent to do so.

Re: moving out of state with my child

In the state of Nevada an unmarried father retains the same legal rights as a married father if paternity can be shown. If you wish to move out of state with the child you will need to file a formal Petition with the Nevada Family Courts to obtain an Order granting custody and allowing you to do so.

I would highly recommend that you consult with an attorney regarding your matter. If you'd like to schedule a free consultation with my office contact my firm at your convenience.
