Who pays what & do I need an attorney?

I live in Nevada and my husband is in CA where we married. I was advised to file for divorce although there is no record of our marriage. I believe this is a no-fault state and I left while he was in prison the 3rd time (drugs) during our marriage. I left when I found out he has also fathered 2 other children during our marriage. Property isn't an issue-that's all done, my question is it's been a year and no support or contact from him at all. Am I obligated to take our daughter for visitation (arranged thru his sister)and do I need an attorney to handle this as there is no record of our marriage...if so because of his felony ways and infidelities, will he have to pay costs? I also understand he is still using drugs...can it be a requirement that he has to be clean in order to have visitation with his daughter? I never worked during our marriage and I am receiving (in my name) many things from creditors. Is he liable for all that since I never worked or am I responsible?

Your situation appears quite complex and I would need to meet with you to provide you with a full answer. If you are clean (drugs and criminal history) and your husband is not, then I would think you could get custody if you wanted. Property issues are separate and you might be responsible for certain debts if they benefited you during the marriage.
