Legal Question in Family Law in Nevada

My wife and I are about to seperate. We have been married for 23 years. We were married 3 and a half years before I retired from the military. I recieve military retired pay, veteran's disability pay and social security. Would like to know what she can get when we seperate.

It would take longer to explain than can really go into an e-mail, but the short version is that community property division is of one of that property that accrued during the marriage. On the facts you post, 1/2 x 3.5 divided by 20 (or your actual length of military service. A very small percentage. And not applicable to disability pay.

A complete discussion of division of military retirement can be reviewed in my article "Divorcing the Military: How to Attack, and How to Defend," posted at http://www.willicklawgroup.com/military_retirement_benefits.

But to actually get an idea how things are likely to play out, you should schedule a consultation with a family law expert trained in military-related divorce. Good luck!
