Legal Question in Civil Litigation in Nevada

Small Claims

I filed small claims suit and have been given a court date. I loaned an ex-boyfriend money to pay off his court debts and DMV fines. We had a verbal agreement that he would make monthly payments. I also drafted a promisary note that he signed agreeing to these conditions; however when he moved out of my home he took the paper and I'm sure he has disposed of it. Does verbal agreement hold up in Nevada court. If so is there a NRS that I can refer to. He also owes past cell phone bills that im also suing for...Any info or advice u have would be GREATLY appreciated! thanks

Re: Small Claims

Verbal agreements for loans are legal in Nevada. However, your problem is proving you lent him the money if he denies it. If you have cancelled checks or credit card charges you made for him then you can meet your burden of proof. Otherwise he will be "he said, she said." Then you'd lose as you have the burden of proof.
