Legal Question in Medical Malpractice in Nevada

Who pays the legal and court costs ?
We have filed a malpractice action against 2 Doctors. One has settled with us but the other wants a trial. If we lose, will we have to pay his costs? The Nevada Medical Board has ruled in our favor.
