Legal Question in Personal Injury in Nevada

fall due to pothole

I fell in a pothole while on vacation. It has been 8 months and I just had surgery necessary due to fall. I may need surgery in the near future as well. There is no insurance company involved but a representative of some sort. Am I better off dealing with a lawyer to ensure a good settlement and all bases covered?

Yes, for a variety of reasons. First, the owner of the property may deny liability stating that you should have seen the pothole or that the pothole was not there long enough for them to known about it and fix it.

Further, you are not in the city where it happened and it will make it harder to negotiate with an adjuster because he will claim a sort of "home field" advantange.

Finally, an adjuster will low ball you because he may think that you don't know the value of the case or how to determine the value. A lawyer will have a book of cases with jury verdicts and could cite how much a jury awarded in a similar case.

Yes, it is much better to use a lawyer.
