Legal Question in Real Estate Law in Nevada

Las Vegas home

We relocated from Las Vegas 2 yrs ago. We rented out the home 5 months ago (verbal agreement)while we were trying to short sell the home, to a person from the Realestate company who listed the home. The renters never paid rent and totally trashed the home. approx $10,000 in damages. (The person was fired from the realestate company 3 month ago) We just turned off all utilities and they finally left. Forclosure is scheduled for April. We have no money and feel totally helpless. We feel the realestate company who gave her a key should have some responsibility. Do we have any options? We just had buyers walk because the house is trashed!

Your story states you rented out the house on a verbal agreement. The responsibility for damages is yours. You can sue the tenant for damages and the lost sale.

Typically the owner is protected by a security deposit and rent paid in advance. Unfortunately, market conditions don't always allow you to rent and get this security. If the real estate agent had your permission to rent under the actual terms rented (whatever they were with respect to security deposit and prepayment of rent) I don't see what you can do. If the real estate company never secured your agreement to the rental terms with respect to security deposit and prepayment of rent, perhaps, you have a claim. However, the real loser is the mortgage company since you stated you were looking at a short sale. (I am assuming that you do not plan to pay off the entire balance of the loan.)

I think it is unlikely that you have a viable case against the real estate company.
