Legal Question in Real Estate Law in Nevada

repos

I bought furniture from McMahns in reno nv a while back and was making payments, i can no longer afford the payments and want them to come and take it, but they say they cannot,they have no one to pick up the stuff,cause there office is now California,they sais they would take me to small claims court or garnish my wages, what can I do..

This is pretty simple, really. You can either keep the furniture and pay your bill as you committed to do, or sell the furniture and apply the proceeds to the debt. Keep in mind that even barely used furniture sells for only about 1/4 what you just paid, so you won't recover much from selling it to someone else.

The store has no legal obligation to relieve you of your debt by reclaiming the furniture, and even if it could do so, I guarantee they would not give you even close to the value you can get from listing it in the paper or on Craigslist and getting what you can for it.

You made a contract and cannot just walk away from it without suffering economic consequences. If you choose to just stop paying, they certainly will come after you in small claims court, just as you would if someone else owed you money.
