2 home owners, one not paying

my mother co sighned for my husband to buy our house, we built her an appartment type thing. we have been argueing forever because she has not held up her part of the deal and she has now been refusing to pay her portion of the mortgage taxes, and insurance. we have a tax lien on her behalf, and she is 2 and a half months behind on her share of mortgage. i also found out as well that we have no house insurance at this moment because she failed to pay the agreed insurance this year. what should we file with the court to get her out before our house gets foreclosed on????

This is a difficult question and there are several ways to approach it. I would need a lot more detail in order to provide a substantive response. You do not indicate if the agreement is in writing or just something that was discussed, but never written. You do not indicate if Mother's name is on the deed or just that she co-signed on the debt. You may have to pay the past due money yourself and then sue her for the cost. I would urge that you consult with an attorney who can review all the documents and provide a more substantive response.
