Legal Question in Landlord & Tenant Law in New Hampshire

rental

i rent a small home with an inlaw apt. i am responsible for the utilities. The tennant in the inlaw has been evicted an refuses to leave. Instead they are operating the heat with doors open, air coditioners simultaneously,plugging in construction lighting and operating an electric oven with the oven door open. Are they commiting larceny.

Assuming you have completed a lawful eviction proceeding through the court, you should consult with the sheriff's department about removal of the tenant and his possessions. You should be ready to change the locks on the premises under the supervision of the law enforcement officials. Generally, when a tenant remains after a lawful eviction it is trespass.
