Legal Question in Real Estate Law in New Hampshire

Does not pay condo fee.

I live in a building with 3 condo units. 2 owners pay the condo fee $60.00 every month and the 3rd has not paid in over 2 years. He is also the Fire Chief of the Town. What can we do besides just putting a lean on his home?

Re: Does not pay condo fee.

The answer to your question requires an examination of the Condominium Declaration, Bylaws, and related documents. The procedure to collect for monthly assessments is generally detailed. I expect you'll need the assistance of an attorney to place a lien on the property or to foreclose that lien and take possession, if that's an option. Occasionally there are rights to notify mortgage holders and obtain their support.

Without a careful review of the documents, it's difficult to suggest an appropriate course of action.
