Legal Question in Real Estate Law in New Hampshire

Quieting a deed

Can an individual file to quiet a deed or do you need an attorney to file? If an individual can file themselves where do they obtain the forms to file?

Thanks

Re: Quieting a deed

A Petition to Quiet Title is an Equity Action under state statute. It can be filed by an individual without an attorney. However, the rules of pleading and practice must be followed and the case must be mapped out with all the specific details along with proper notification to all parties and potentially interested persons according to statute and Rules of Court. You will also need to prepare an appropriate decree and any necessary instruments for recording at the appropriate Registry of Deeds.

I would suggest that this is generally a complex enough legal matter that you should consult with an attorney before filing anything with the Court.
