Brother-In-Law

My brother-in-law recently passed away with no will. He was very sick. He has a daughter that is 12 years old. My husband and I paid for the funeral. Is there a way that we can close out his checking account and use the money toward the funeral? He had nothing, except a few dollars in his checking account.

My sympathy on your loss and the tragedy your niece must endure. At this point you will need to commence probate administration in the county where your brother-in-law resided. The funeral exepnses are a priority claim and are one of the first bills to be paid from the estate (checking account.)

If you will be caring for your niece you'll also need to take out guardianship over her to properly take care of her.
