Legal Question in Disability Law in New Jersey

Ada

I have been teaching fourth grade for 22 years. When we departmentalized many years ago, I taught Math as well as Science and Social Studies due to my disability of having one eye and glaucoma in the other eye. I am under the care of a reknowned doctor in NYC for my conditon. Language Arts and/or a grade change could be detrimental to my vision due to the increased reading necessary for either change. I'd like to know what my rights are to maintain my current position as a fourth grade Math teacher. My doctor is adamant that I not be changed. The strain on my one eye would be great. Please advise me of my rights. All my evaluations in my current position have been outstanding.

Re: Ada

You are protected under the ADA; however, the law does not allow what appears to be "micro-managing" your employers reasonable business decision. This does not mean, however, the you are foreclosed from asserting a claim if the purpose of a transfer is to put you in a position where you would be unqualified to teach because of your limitations. If you are suffering from discrimination, visit www.EEOC.Gov and www.lwade-law.com.
