schools ability to ban a student from attending school

My son was charged with drug possesion and possesion with intent to sell. He served 16 days in detention and we were allowed to transfrer him to a 28 day in patient program. He is on probation for 2 years. The school is saying they have to present the situation to the board to vote if he will be allowed to be reinstated in school or an alternative situation. He has a 504 plan.Can they do that?

Free, universal public education is available in New Jersey, but the school can act to remove students from school and place same in an alternative educational situation where that student

poses a danger to the other students.

Was this in school grounds? If not, I'm not sure where they are going here. Many students have criminal issues and they stay in the same school. Regardless, the real question is, what will you do about it?
