Legal Question in Bankruptcy in New Jersey

about selling a home and filling bankruptcy last year

ok we filed for bankruptcy last year in trenton,nj. it was dismissed in august of 2002..now we want to sell the house we have a buyer and scared that if we sell the creditors will come after us it has been a year now..do you have any advice.. our car and home were not included in the bankruptcy only our credit..please help..

You appear to be confused about what occurred in your bankruptcy. If done correctly, your house and car (and the debts associated with them) would have been included on Schedules on the bankruptcy petition. If it was dismissed, then your debts still exist. The good part, however, is that you can sell your house and not need to worry about those debts, unless they are judgments already. In any case, you need a full review of your situation before any determination can be made as to the direction in which you should be going at this point. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There certainly may be other factors that would change my opinion. Further, no one can rely on advice from an attorney who has not been retained. Since it appears that you have not retained an attorney, you may want to contact an attorney (either me or someone else) to discuss your matter in more detail.
