Delivery Time of the Project is Delayed 14 Months

My question involves business law in the state of: Iselin, NewJersey

Dear Sir/Madam,

First of all, sorry for the possible mistakes in my written English, as it is not my native language.

I have engaged the services of a Company, to create custom code to run a social network (such as Facebook) and further more to implement the site using this code as well as provide the design work or the site. The code they are writing is written from scratch and specially for me.

The Compan`ys estimated project schedule to perform tasks outlines in the proposal was three months.

The agreement date was April 2007, started date was around May, so i was expecting to get the product latest on September 2007, the normal deadline is this.

Since September 2007, they have been delaying the project. 13 months have been passed since their legally agreed deadline, and the project is still not finished!

I already have released the %50 of the Fund. Project is XX,XXX$ worth.

On the last days of September 2007 they have offered %25 discount for me because of their delay.

I wonder, if you can check the agreement papers we signed, and determine if i am able to open a lawsuit.

A delay that long without some justification would certainly seems to be a breach of contract. If you fax or email a copy of your written agreement, I would be in a better position to tell. My contact information appears below.
