Contract with builder

We signed a contract with a builder to do work on our home (replace set of sliding door with a window seat). Contract signed and deposit given on 9/1/01. No additional work was done until end of November, at that time according to our contract we needed to provide builder an additional sum of $2,000, which we did. As of 1/7/02, no additional work has been done. Builder explains he is waiting for concrete truck. Do we have any recourse? Contract does not give any start or end dates. We gave him $2800 and all we have is a hole in yard. Can you give us any suggestions on how to motivate the builder. Do we have any legal rights at this time?

You definitely have legal rights under the circumstances. There are regulations pertaining to home improvement contracts under the New Jersey Consumer Fraud Act. As an example of these regulations, in most cases, a home contractor MUST include a start and finish date in the contract. There are many other requirements that a contractor must abide by. You should seek the advice of an attorney experienced with the New Jersey Consumer Fraud Act.
