No Refund Policy

My husband purchased a pair of sunglasses at an optical store in the mall. Do they have to post their No Refund Policy in the store? It turns out, the sunglasses are crooked, they don't have another pair and they won't refund his money. They never informed him there was a no refund policy until they handed him the receipt with it stamped on there. These are not prescription glasses.

If that's the only place the refund policy appears, then the store isn't complying with the law. The policy has to be on the item itself, at the entrances to the store, or at the register or visible at the point of sale. Giving it after the sale violates the NJ Consumer Fraud Act and NJ Refund Disclosure Laws. Feel free to contact me for more info.

I have read what Glen Chulsky wrote...he is an attorney who does a good deal of consumer fraud work.

Sounds like you ask nicely, then...well, if no other way, then you sue them (if you think it is worthwhile) for consumer fraud, three times the amount you paid plus attorneys fees and court costs. not a great situation, a lot of work to sue.

Report them to Better Business Bureau, and NJ Dept. Consumer Affairs.
