Legal Question in Credit and Debt Law in New Jersey

Can 2 people collect same debt?

Today was the third time I answered the court in reference to 3 Notice for Wage Executions I've received in the past 4 months. Each time, I state that I will make payments to them concerning a past judgement. A collection agency got in touch with me a couple weeks ago and said that their client(same debt) was offering me a pay off(55% of the balance) I paid the account The agency told the attny that I paid my half of balance(I was a co-signer)and to send me a release. The attny contacted their client and made them pull the account from the agency. I received a call from agency stating that they would send my money back and to proceed with attny. Once the account was given to the attny, shouldn't that been pulled from collect.agency? Can both agency and attny try collecting same debt? And if so, was it legal to send my money back when payment was already made with agency? Today as I filed my paperwork with the Court, they told me that Dec. 2 the Judge already signed that the Wage Exec. would be granted. Also, the attny called and asked for $3000 down and monthly payments to keep this out of court, when all along Judge already signed for execution of wages.Help? Thanks

Re: Can 2 people collect same debt?

Your post presents many issues:

1. Were you served with a summons and complaint?; 2. did you create an accord and satisfaction of the debt (occurs when both parties agreed to accept less than owed)?; 3. were you properly noticed of the default of the vehicle?; 4. was the vehicle disposed of in a commercially reasonable manner?. Unfortunately, I can't figure out the answers you need from your post. If you would like a no cost consultation, you can e-mail me or call 908-213-0600.
