Credit Collections Abuse

I am in debt. I have been planning on filing bankruptcy, but I don't have the money. These bill collectors are destroying me. Some of them won't allow me to request that all coorespondence be through the mail. They threaten me, belittle me, make me cry. I understand that their job is collections, but they are rough. I've told them many times that I am not home, but on occassion I felt that I owe them an explanation. When I tell them I am unable to send money, they tell me that I am refusing to me. Is there anything I can do to cease these phone calls? I feel like I have weights on my chest and I don't know what to do. I know bankruptcy will help, but like I said, I can't pay 600 up front to file. I need to file desperately, but need something to stop the calls and vicious harassment of these agency workers. Thank you.

If you tell debt collectors to stop calling and they do not stop, they are violating the Fair Debt Collection Practices Act. There are several NJ law firms that will take your case on that basis alone at no fee to you. Google "FDCPA".

A bankruptcy does not have to be expensive. Keep in mind that once a petition in bankruptcy is filed, you stop paying on your old debts at least for a time. You can then use the income that you would otherwise have used to pay these bills to pay for the costs of bankruptcy. You should discuss your situation with a lawyer (or several). If you have any source of income, you can probably work something out.
