Collection suits must be filed within six years from the time the right to sue arises. That is usually the first day that the debt becomes overdue but the time can be extended if a payment is made for for other reasons that lead the creditor to delay suit.

In the past year or so, there have been many collection agencies that have been trying to mislead debtors into believing that a stale, unenforceable claim is actually enforceable. If you have any doubt as to whether the limitations period has expired, consult a business lawyer.
