Legal Question in Criminal Law in New Jersey

2c:35-10a(4); 2c:36-2

I was arrested for possession of marijuana in the amount of less

than 50 grams,

in violation of N.J.S. 2C:35-10A(4).

And, for the possession of drug paraphernalia, one dutch master cigar, in

violation of N.J.S. 2C:36-2.

This is my first offense. I am a college student in New Jersey. I also have

a

clean driving record. This took place in Mahwah, N.J.

What kind of sentence can I expect from the judge?

These are both Disorderly Persons offenses. Each carries a maximum penalty of 6 months in jail and over $1,000 in fines, as well as 6 mos. or more loss of your driving priveleges. If you are found guilty you may or may not get jail time, but you will lose your license. If you go with a lawyer there is a chance to minimize or even eliminate the penalties - I would have to review your entire case and the evidence they have before I can give you a definite answer. I suggest you at first consult with an attorney before doing anything. You have two things to worry about. First is a criminal record. You can probably avoid that. The second is a loss of your driver's license. That's more tough and that's why you may need an attorney to help you out.
